Privacy Policy

Last updated: October 27th, 2026

1. Introduction

1.1 This Privacy Policy describes how Nesu ("Nesu", "we", "us" or "our"), collects, uses, discloses and protects your personal information when you visit nesustudio.com (the "Site"), make a purchase, subscribe to our communications, or otherwise interact with us (collectively, the "Services"). "You" and "your" refer to any individual whose personal information we collect, whether a customer, a subscriber or a website visitor.

1.2 We collect, use and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances, and with your consent where the law requires it. Where we rely on your consent, you may withdraw it at any time, as described in Section 9.

1.3 This Privacy Policy forms part of our Terms of Service. Please read it carefully. If you have questions, contact us using the details in Section 12.

2. Changes to this Privacy Policy

2.1 We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal or regulatory reasons. We will post the revised Privacy Policy on the Site and update the "Last updated" date above. Where a change is significant, or where the law requires it, we will provide additional notice or seek your consent.

3. Personal information we collect

3.1 "Personal information" means information about an identifiable individual. The information we collect depends on how you interact with us.

3.2 Information you provide to us directly may include:

  • (a) Contact details, such as your name, shipping and billing address, email address and phone number;
  • (b) Order information, such as the products you purchase, order history, payment confirmation and delivery details. We do not store your full payment card number; payments are processed by our payment providers;
  • (c) Account information, such as your login details and preferences, if you create a customer account;
  • (d) Subscription information, such as the email address or phone number you give when you sign up for our emails or texts, and your communication preferences;
  • (e) Checkout information, such as the email address or phone number you enter when you begin checkout, even if you do not complete your purchase;
  • (f) Customer support information, such as the content of your messages to us and any photos you send, for example of a damaged item;
  • (g) Reviews and content, such as written reviews, star ratings, photos and videos you submit; and
  • (h) Survey responses, such as answers you give in on-site or post-purchase surveys.

3.3 Information we collect automatically. When you use the Site or open our emails, we and our service providers automatically collect certain information ("Usage Data") using cookies, pixels, tags and similar technologies ("Cookies"). Usage Data may include your device and browser type, IP address, approximate location derived from your IP address, pages viewed, products viewed or added to cart, how you arrived at the Site, how you interact with pages (including clicks, scrolling and session recordings), and whether you open or click our emails.

3.4 Information from third parties. We may receive personal information about you from:

  • (a) Shopify and other service providers that support our Site and Services;
  • (b) our payment processors and financing providers, which confirm your payment status;
  • (c) carriers and fulfillment partners, which provide delivery and tracking updates; and
  • (d) advertising and social media platforms, such as Meta and Google, which may share information about how you interacted with our ads.

3.5 You may choose not to provide certain information, but some features, such as placing an order, may not be available without it.

4. How we use your personal information

4.1 We use personal information for the following purposes:

  • (a) Providing products and Services: to process payments, fulfill and deliver orders, arrange shipping, handle returns, exchanges and warranty claims, manage your account, and send you transactional messages such as order confirmations and shipping updates;
  • (b) Customer support: to respond to your questions and requests and resolve issues;
  • (c) Marketing and advertising: to send you marketing communications where you have consented or where the law otherwise permits (see Sections 4.2 to 4.5), and to show you relevant advertising on our Site and on other websites and platforms (see Section 5);
  • (d) Reviews and surveys: to invite you to review your purchase or answer surveys, and to publish reviews in accordance with Section 7;
  • (e) Improving our Services: to analyze how visitors use the Site, understand what is working, fix problems, and develop new products and features;
  • (f) Security and fraud prevention: to detect, investigate and prevent fraudulent, unlawful or harmful activity, and to protect our customers, our business and others; and
  • (g) Legal compliance: to comply with applicable laws and regulations, including tax and accounting obligations, to respond to lawful requests, and to establish, exercise or defend legal claims.

4.2 Email marketing. If you subscribe to our mailing list, for example through a sign-up form, pop-up or our website footer, or by checking the marketing box at checkout, we will send you marketing emails about our products, offers, launches and related content. You do not need to make a purchase to subscribe. Where Canadian law permits, we may also send marketing emails to customers within two years of a purchase. Every marketing email includes a link to unsubscribe.

4.3 Abandoned checkout and browsing reminders. If you subscribe to our emails, or enter your email address or phone number at checkout and agree to receive marketing, we may send you reminders about products you viewed, added to your cart or left in an incomplete checkout. We treat these reminders as marketing communications. We only send them where you have consented or where the law otherwise permits, and each one includes a way to unsubscribe.

4.4 Text messages (SMS). We will only send marketing text messages, including cart reminders and offers, if you have expressly opted in to receive them, for example by checking the SMS box at checkout or submitting a sign-up form that clearly describes our text messages. Consent to receive marketing texts is not a condition of any purchase. Message frequency varies, and message and data rates may apply. Reply STOP to unsubscribe or HELP for help at any time. We do not sell or share your mobile number or SMS opt-in consent with third parties for their own marketing purposes.

4.5 Personalization. To make our marketing more relevant, we may use information such as the products you viewed, your purchase history, your approximate location and whether you opened or clicked our emails to tailor the content and timing of the messages we send you.

4.6 Unsubscribing. You can stop receiving marketing communications at any time by clicking "unsubscribe" in any marketing email, replying STOP to any text, or contacting us using the details in Section 12. We will process your request within ten (10) business days. Unsubscribing from marketing will not stop transactional messages about your orders.

5. Cookies and tracking technologies

5.1 We use Cookies to operate the Site, remember your cart and preferences, understand how the Site is used, and measure and personalize advertising. For information about the Cookies used to power our Shopify store, see Shopify's Cookie Policy.

5.2 We use the following categories of Cookies:

  • (a) Necessary: required for the Site to work, such as the cart, checkout and security. These cannot be switched off;
  • (b) Analytics and performance: to understand how visitors use the Site, including session recordings and heatmaps provided by Microsoft Clarity;
  • (c) Marketing and advertising: to measure our ads and show you relevant ads on other websites and platforms, including through the Meta pixel and Google advertising and analytics tags; and
  • (d) Preferences: to remember choices such as your region or currency.

5.3 Your choices. When you first visit the Site, a cookie banner lets you accept or decline non-necessary Cookies. If you are in Quebec, analytics and marketing Cookies are off until you accept them. You can change your choice at any time through [Cookie preferences] in the footer of the Site. You can also block or delete Cookies through your browser settings; doing so may affect how the Site works.

5.4 Global Privacy Control. The Site recognizes the Global Privacy Control ("GPC") signal. If your browser sends a GPC signal, we will treat it as a request to opt out of the sale or sharing of your personal information for targeted advertising for that browser, and, where we can associate the signal with your customer account, for that account. Learn more at globalprivacycontrol.org. We do not respond to other "Do Not Track" signals.

6. How we disclose personal information

6.1 We do not sell your personal information for money. We disclose personal information only as described in this Privacy Policy, including:

  • (a) Service providers that perform services on our behalf under contracts requiring them to protect your information, including e-commerce hosting (Shopify), payment processing, fulfillment, warehousing and shipping carriers, order tracking (17TRACK), email and SMS marketing (Klaviyo and Shopify Messaging), reviews (Loox), surveys (Zigpoll), site search (Searchanise), analytics (Microsoft Clarity and Google), customer support and IT services;
  • (b) Advertising and marketing partners, such as Meta and Google, which receive information through Cookies and similar technologies, or when we upload hashed contact lists, to measure our ads and show you relevant advertising. These partners use your information in accordance with their own privacy policies;
  • (c) With your direction or consent, for example when you ask us to share information with a third party, connect a social media account, or post a public review;
  • (d) Business transfers, in connection with a merger, acquisition, financing, sale of assets or similar transaction, subject to confidentiality protections; and
  • (e) Legal reasons, to comply with the law or a lawful request, to enforce our [Terms of Service], or to protect the rights, property or safety of Nesu, our customers or others.

6.2 "Sale" and "sharing" under U.S. state laws. Some U.S. state privacy laws define "sale" and "sharing" broadly to include disclosing information through advertising Cookies or customer lists for targeted advertising, even when no money changes hands. To the extent our use of advertising partners such as Meta and Google is considered a "sale" or "sharing" under those laws, it involves the following:

Category of personal information

Categories of recipients

Identifiers, such as email address, phone number (hashed) and device or cookie IDs

Targeted advertising and ad measurement

You can opt out at any time, as described in Section 9.4. We do not knowingly sell or share the personal information of individuals under 16 years of age.

6.3 We do not use or disclose sensitive personal information to infer characteristics about you.

7. Reviews, photos and other content you share

7.1 If you submit a review, photo, video or other content through the Site or our review provider ("User Content"), it may be published on the Site together with your first name, last initial and, if you provide it, your city. Please do not include personal information you do not want made public.

7.2 We will ask for your permission before using your User Content in advertising or on social media. We will never use your photos, videos or name in our marketing without your consent.

7.3 You may ask us to remove your User Content or stop using it at any time by contacting us using the details in Section 12. We will stop using it in new materials and remove it from the Site, although content already published by third parties or in materials already distributed may not be fully retrievable.

7.4 We do not sell User Content to third parties.

8. Children, security, retention and transfers

8.1 Children. Our Services are not directed to children, and we do not knowingly collect personal information from anyone under the age of majority in their province or state. If you believe a child has provided us with personal information, please contact us and we will delete it.

8.2 Security. We use reasonable administrative, technical and physical safeguards appropriate to the sensitivity of the information to protect personal information against loss, theft and unauthorized access, use, disclosure, copying or modification. Payment information is processed by our payment providers using encryption. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach of security safeguards involving your personal information creates a real risk of significant harm, we will notify you and the relevant authorities as required by law.

8.3 Retention. We keep personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, maintain your account, honour warranties, comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements. When personal information is no longer needed, we securely delete or anonymize it.

8.4 Where your information is processed. We are based in Canada. Our service providers and partners, including Shopify, may store and process personal information in Canada, the United States and other countries. Personal information processed outside your province or country may be subject to the laws of that jurisdiction and accessible to its courts, law enforcement and national security authorities. Before transferring personal information outside Quebec, we assess whether it will receive adequate protection, as required by Quebec law.

9. Your rights and choices

9.1 Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may be limited by law.

  • (a) Access: to know whether we hold personal information about you, and to receive a copy of it and information about how it is used and disclosed;
  • (b) Correction: to ask us to correct inaccurate or incomplete personal information;
  • (c) Deletion: to ask us to delete your personal information, subject to legal exceptions such as tax record-keeping;
  • (d) Portability: to receive your personal information in a commonly used format or have it transferred to another organization;
  • (e) Withdraw consent: to withdraw consent to our use of your personal information, subject to legal or contractual restrictions. Withdrawing consent may mean we cannot provide certain Services;
  • (f) Opt out of marketing: as described in Section 4.6; and
  • (g) Opt out of sale, sharing and targeted advertising: as described in Section 9.4.

9.2 Quebec residents also have the right to be informed when a decision about them is based exclusively on automated processing, to ask that information be de-indexed where the law allows, and to be informed of the technologies used to identify, locate or profile them and how to turn them off.

9.3 How to make a request. To exercise any of these rights, contact us using the details in Section 12. We may need to verify your identity before responding, for example by asking you to confirm your email address or order details. You may use an authorized agent to make a request on your behalf; we may ask for proof of authorization and to verify your identity directly. We will respond within the time required by applicable law, generally within 30 days in Canada and 45 days in the United States. We will not discriminate against you for exercising your rights. If we decline your request, we will explain why, and you may appeal by replying to our decision.

9.4 U.S. residents: opting out of sale or sharing. If you live in a U.S. state with a consumer privacy law, such as California, Colorado, Connecticut, Virginia or Utah, you may opt out of the "sale" or "sharing" of your personal information for targeted advertising by:

  • (a) visiting our Your Privacy Choices page;
  • (b) turning on the Global Privacy Control in your browser (see Section 5.4); or
  • (c) emailing us at contact@nesustudio.com with the subject line "Opt out of sale/sharing", including your name, the email address you use with us and your state.

Because many of these activities rely on Cookies, an opt-out made through the Site applies to the browser and device you use. If you use other browsers or devices, or clear your Cookies, you may need to opt out again.

10. Complaints

10.1 If you have a concern about how we handle your personal information, please contact us first so we can try to resolve it. If you are not satisfied with our response, you may contact the privacy regulator where you live, including:
